Terms of Service

These terms are the agreement between you and Comitry. You accept them when you create an account, and the version you accepted is recorded with the date.
If you publish content or take payment on Comitry as a coach, the Coach Agreement applies to you as well.
1. Who we are

We answer messages about these terms, about your account, and about a payment at that address. It is a real address read by a person, not an autoresponder.
2. What Comitry is
Comitry is a wellbeing platform. You can join groups, talk to other members in groups and in direct messages, keep a private journal, and follow coaches who publish content about fitness, wellbeing, mental health and nutrition.
Comitry is not healthcare. It does not provide medical advice, a diagnosis, or care of any kind. It is not a medical device. It is not a crisis service, and nobody here monitors conversations for signs of danger.
Nothing on Comitry replaces a qualified professional. If you need medical help, contact one. If you are in immediate danger, contact your local emergency services. We do not list helplines or direct you to a particular service: we are not equipped to choose one for you, and pretending to would imply an involvement we do not have.
3. Who can use Comitry
You must be 18 or older. You confirm your age when you create your account, and we record that confirmation. If we learn that an account belongs to someone under 18, we close it and delete the data.
One account per person. Do not share your account, and do not let anyone else use it. Keep your sign-in details to yourself.
4. Your account
Sign-in is handled by Clerk, which holds your email address and your password or social sign-in. Your Comitry profile — your handle, display name and anything you choose to write in it — is held by us.
- Your profile is private by default. Nothing about you is discoverable until you choose to make it so.
- Your handle is permanent. You cannot change it, and nobody else can ever take it, including after you delete your account. This is deliberate: handles appear beside everything you say, and letting a stranger inherit yours would let them inherit the trust that came with it.
5. What is free, and what is free forever
Comitry is free to use. There is no charge for an account, and no paid membership tier.
These surfaces are free forever and will never be put behind a payment:
- Peer groups
- Direct messages
- Your private journal, and the mood you can attach to an entry
- Reporting a safety concern
Subscribing to a coach buys that coach's content. It never buys the ability to reach other people, and it never buys help.
6. Coaches are independent
Coaches are not employed by Comitry and are not our agents. They are independent people who publish content and run groups using our platform.
- Qualifications shown on a coach's profile are declared by that coach. We do not certify, endorse or check them, and we say so on every profile.
- Coaches accept a scope of practice before their application is reviewed: they share guidance, programmes, education and encouragement, and they agree not to diagnose or treat anything, not to advise anyone about prescribed medication, and not to claim a qualification they do not hold.
- Any relationship you form with a coach is between you and them. We are not a party to it. We are not responsible for the guidance a coach gives you, and we do not supervise it.
- Selling content is not self-service. A person at Comitry reviews an application before a coach can charge for anything, and approval can be withdrawn.
- A coach who sells on Comitry is acting as a trader, in business on their own account. They are bound by the Coach Agreement, which sets out what they may and may not do, and it is published so you can read it before you pay anyone.
If a coach behaves in a way that breaks our rules, report it. We will review it and may remove content, stop them selling, suspend them, or close their account.
7. Paying for a coach's content
Who you are paying
A coach sets their own monthly price. We collect that payment: the contract for the subscription is with us, we are the merchant on your statement and on any receipt, and we then pass the coach their share. We take a platform fee out of what you pay and the coach receives the rest.
That means your consumer rights under these terms — cancellation, withdrawal, conformity, refunds — are ours to answer for, not the coach's. You never have to chase a coach to enforce them.
Card details are collected and held by Stripe, our payment provider. We never see or store your card number. A coach never sees it either, and can never change or cancel your payment method.
Price and tax
- The price is shown on the coach's profile and again at checkout before you confirm anything.
- The price shown to you is the total you pay, including any applicable VAT. Where a tax amount applies it is itemised at checkout and on your receipt.
- Subscription prices are between €5 and €500 per month.
- If a coach changes their price, the new price applies from your next renewal and we tell you before it takes effect. You can cancel instead.
Renewal
A subscription renews every month on the day you started it, automatically, until you cancel. Each renewal is charged to the payment method on file.
Cancelling
You can cancel at any time online, in a few clicks, with no need to contact anyone, no phone call, no reason required and nothing to justify.
The cancellation route is free and reachable directly from the page where you subscribed as well as from your subscription settings.
We confirm your cancellation in writing, and tell you the exact date your access ends.
Cancelling takes effect at the end of the month you have already paid for. You keep access until then, and you are not charged again.
Until that date you can change your mind and keep the subscription.
We never cancel you immediately when you have paid for the month.
This is separate from the right of withdrawal in section 8, which is a right to a refund rather than a way to stop future renewals.
When a payment fails
If a renewal is declined, you are not cut off straight away. Stripe retries the card over the following days, and we tell you on your subscriptions page that one attempt failed and will be retried.
You can replace your card from that page, which opens Stripe's own secure card form. Once a payment succeeds the warning clears itself.
If every retry fails, the subscription ends and access to that coach's paid content stops. You can subscribe again afterwards.
Refunds
Beyond your legal rights in sections 8 and 9:
- If a coach has not delivered what they described, or their content is removed while you are paying for it, contact us and we will look at a refund.
- We do not otherwise refund part of a month you have used.
- If you dispute a charge with your bank instead of contacting us, we will cooperate with the bank's process — but writing to us first is faster and usually settles it.
8. Your right to withdraw
Because you are buying a digital service online as a consumer, you have 14 days from the day your subscription starts to withdraw from it, without giving a reason.
You start using a coach's content immediately, which is the point of subscribing. So before you pay we ask you to confirm two things: that you want access to start straight away, and that you understand you will have to pay for the part of the month you have used if you then withdraw. You cannot pay without both, and the date and time you confirmed are recorded on the subscription.
If you withdraw within those 14 days:
- We refund what you paid, less a proportionate amount for the days you had access, within 14 days of being told, using the same payment method.
- We do not charge you a fee for withdrawing.
To withdraw, use the Withdraw button on your subscriptions page while the 14
days are open: it ends the subscription immediately and starts the refund, and the
amount is shown to you. You can also write to
contact@comitry.com and say that you are withdrawing — a
plain message is enough, and we confirm receipt in writing.
Withdrawing applies to the subscription you have just bought. To stop future renewals of a subscription you have had for longer, cancel it as described in section 7.
9. What we owe you about the service
The paid content and the platform must match what we described, and must keep matching it for as long as you are paying — not only on the day you subscribed.
We are responsible to you for the whole of it, including the parts a coach produces. Comitry is the party you contracted with, so if a coach's content is materially not what was described, or is removed, or the paid part of the service does not work as it should, you come to us and we answer for it. We may have our own argument with the coach afterwards; that is not your problem.
If something is not as described, tell us. You can ask us to put it right and, where we cannot, ask for a reduction in the price or to end the contract with a refund for what was not delivered. We do not charge you for a period in which the service was not what we promised.
We do not offer a guaranteed service level, and we say so plainly rather than implying one. That does not reduce our duty to supply a service that works as described.
Nothing in these terms removes or reduces the legal guarantees your national law gives you as a consumer.
10. Your content
You keep ownership of everything you write. By posting it, you give us permission to store, copy and display it only so far as running the product requires — showing your message to the other people in your group, backing it up, and delivering it to your own devices. That permission is free of charge, worldwide for as long as your content is on Comitry, and it exists for no other purpose. We do not use what you write to advertise, to train anything, or to sell to anyone.
You are responsible for what you post, and you confirm you have the right to post it.
Some things behave differently by design:
- Journal entries are yours alone. Nobody else can read them, including us. Deleting one deletes it outright rather than hiding it, and it cannot be recovered.
- A message in a conversation is also part of other people's conversation. Deleting your account does not remove what you said from the threads other people took part in. Section 12 says exactly what happens.
11. What is not allowed
Do not:
- Harass, abuse, threaten, stalk or impersonate anyone
- Post content that sexualises anyone, or any sexual content involving a minor
- Present yourself as a medical professional you are not, offer a diagnosis, claim to treat anything, or tell someone to change prescribed medication
- Post content promoting self-harm, suicide, disordered eating, or extreme restriction of food or exercise
- Share someone else's private information, or repeat outside Comitry what was said in a group
- Sell, recruit or advertise, except through a coach subscription
- Scrape, automate, overload, probe or attempt to break the service, or evade a removal with a new account
- Post anything unlawful
The Community Guidelines say what this means in practice and form part of these terms.
12. Moderation, and losing your account
Anyone can report a message, a person, a group or a piece of content, from the
product or by writing to contact@comitry.com. Tell us where it
is and what is wrong with it. We review reports and may remove content, mute or
remove someone from a group, stop a coach selling, or suspend an account.
What a suspension does, and does not do. A suspended account cannot post, join a group, start a conversation, publish anything or subscribe to a coach. It keeps everything that is yours or is your way back: your journal, a copy of your data, closing your account, stopping anything you pay for, reporting something, and asking us to look again at the suspension itself. Anything you were paying for is cancelled at the end of the month you have already paid for, so you are not charged again while suspended. We do not lock you out of your own account.
Our point of contact for authorities, and for anything about how we moderate, is

- We tell you what we decided and why, and which rule it was based on, unless the law prevents us.
- You can ask us to look again by replying to that message, and where we reasonably can a different person reviews it.
- Where a breach puts someone's safety at immediate risk we act first and explain afterwards.
- Where the breach is minor we give notice before ending anything, unless doing so would defeat the point.
We do not promise a response time for a report, and a report is not a request for help on another person's behalf. If someone may be in immediate danger, contact emergency services.
13. Closing your account
You can delete your account at any time from your account settings. When you do:
- Your journal entries are permanently deleted. They cannot be recovered.
- Your profile stops being visible and stops being reachable or searchable.
- Your handle stays reserved and is never reused, so nobody can take it and appear to be you. It is retained on its own, with nothing else attached to it in public view.
- What you wrote in conversations stays in those conversations, no longer attached to an active profile. We keep it because the other people in a thread have their own interest in it still making sense, and because removing one side of a conversation rewrites theirs.
- Any active subscription is cancelled and not renewed.
- Records we must keep by law — payment and tax records, records of consents, and audit records of privileged actions — are kept for as long as the law requires.
You can take a copy of what you wrote with you. Before you close your account, and for 30 days afterwards, you can ask us for an export in a common machine-readable format, free of charge. We do not charge for it, we do not require you to keep the account open to get it, and we will not withhold it.
The Privacy Policy sets out exactly what is deleted, what is kept, for how long, and how to ask us for a copy of your data or for something to be removed.
14. Availability and changes to the product
We work to keep Comitry available and working as described. Maintenance happens, and we will keep it short and tell you when we can.
We may change, add or remove features, but only for a reason, and only these reasons: a change in the law or a decision of a court or regulator; keeping the service secure; a technical change that does not reduce what you get or raise your price; making something genuinely better; or adapting to the number of people using it. We do not reserve a right to change whatever we like whenever we like.
Where a change materially reduces what you get, we tell you at least

then end a paid subscription free of charge before the change takes effect, and we
refund what you have paid for and will not receive.
Nothing we change applies retroactively to a period you have already paid for.
15. Our responsibility, and its limits
We are responsible for providing Comitry with reasonable care and skill, and for the things these terms say we will do.
To the extent the law allows, we are not responsible for:
- The guidance, content or conduct of a coach or another member
- A decision you take about your health, training, food or exercise
- Content another member posts, before we have been told about it
- Loss or damage that was not reasonably foreseeable
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for your rights as a consumer under mandatory national law.
There is no cap on what we owe you. We have deliberately not written one, because a clause reducing a consumer's right to compensation is void in France anyway and including it would only make the rest of this document less trustworthy.
Ordinary limits still apply: we are not liable for something that was not caused by us, or for an event genuinely outside our control.
16. Changes to these terms
If we change these terms materially we will tell you at least

you to accept the new version. We only change them for a reason — a change in the law, a
decision of a court or regulator, a change to the product described in section 14, or a
change in how Comitry is priced or operated — and we say which reason applies.
If you do not want to accept a change, you can stop using Comitry and close your account, and we will refund anything you have paid for and will not receive. A change never applies to a period you have already paid for.
Every version you accepted, and when, is recorded.
17. Complaints and disputes
Write to contact@comitry.com first. We would rather fix
something than argue about it, and most things are a misunderstanding.
If that does not resolve it:
- You can use a consumer mediator, free of charge. Ours is
[TO BE CONFIRMED: the name, postal address and website address of the listed consumer mediator Comitry is signed up to. A French trader must be signed up to one, must pay for it, and must publish its website address.] - You can also complain to the consumer protection authority in your country.
- Writing to us first is not a condition of anything. Mediation is optional, and nothing here stops you going to court.
18. Applicable law and courts

19. The rest
- If part of these terms turns out to be unenforceable, the rest still applies.
- We may transfer these terms to another company if our business is sold, and we will tell you. You keep every right you had, and you can close your account.
- You may not transfer your account to anyone else.
- These terms, the Privacy Policy, the Community Guidelines, the Safety Policy and — for coaches — the Coach Agreement are the whole agreement between us.
