Coach Agreement
Version: 2026-08-26 · Draft pending review by a qualified lawyer
These are the additional terms for anyone who publishes content or takes payment on Comitry. The member Terms of Service, the Community Guidelines and the Safety Policy still apply to you, and this agreement adds to them rather than replacing them.
You accept it when you apply to become a coach. Your acceptance and its date are recorded.
1. You are independent
You are not employed by Comitry, you are not our agent, and this is not a partnership or a joint venture. You decide what you publish, what you charge, and how you work with your clients.
You are responsible for:
- Your own income tax, social contributions and VAT where they apply to you
- Any registration, licence or qualification your work requires where you live and where your clients are
- Your own professional insurance, if you need or want it. We recommend it and
[TO BE CONFIRMED: whether Comitry will require proof of professional indemnity insurance before approving a coach who sells — a business decision with a real effect on how many coaches you can recruit]
We provide the platform, collect the payments and pass on your share. That is the extent of it.
2. Scope of practice
You agree to work only within this scope:
- Sharing guidance, programmes, education and encouragement
- Drawing on your own training and experience
- Referring people to qualified professionals when something is beyond you
You agree not to:
- Diagnose any condition
- Treat any condition, or claim to treat, cure or prevent one
- Advise anyone to start, stop or change prescribed medication
- Describe yourself as a therapist, psychologist, doctor, dietitian or nurse unless you genuinely hold that qualification and the title is lawful for you to use where you practise
- Present Comitry as a clinical service or as a crisis service
- Offer anything to anyone under 18
You confirm you understand this scope before your application is reviewed, and your acceptance is recorded with a timestamp. Working outside it is the fastest way to lose your account.
3. Your qualifications
You may list qualifications, a licence number and an issuing body on your profile. You confirm that everything you list is accurate, current, and yours.
We do not check or certify any of it, and we tell members so. Your profile states plainly that anything shown there is declared by you and not certified by Comitry. Do not imply otherwise anywhere in your content, your profile, or your messages. Do not present a training certificate as a professional qualification, and do not use a check mark, a badge, the word "certified", or any other verification language about yourself.
Protected titles are not available on Comitry at all. In several countries,
including France, titles such as psychologue, psychothérapeute, diététicien, médecin
and infirmier are reserved by law and using one without the entitlement is a criminal
offence. We do not let a coach claim one on a profile, whether or not it is true,
because we have no way to check it. If you hold one of those titles and want it shown,
write to us — that requires us to verify it against the relevant public register
first, and [TO BE CONFIRMED: whether Comitry will offer register-verified titles at launch, or refuse them entirely until it can verify them. Refusing is the safer default.]
Words that borrow the authority of healthcare are also not allowed anywhere in what you write: consultation, patient, doctor, therapy, treatment, diagnosis, prescription, cure. Use client, member, session, content.
Misrepresenting a qualification ends your account, and we may tell affected clients that it did.
4. Content standards
In addition to the Community Guidelines and the Safety Policy, you must not publish:
- Extreme calorie restriction, fasting as a goal, or purging
- Specific calorie targets, goal weights or body-fat percentages presented as targets for other people
- Training through injury, or exercise framed as punishment
- Before-and-after imagery, or any testimonial, presented as a promise of results
- Claims to cure, treat or prevent any condition, or any health claim you cannot support
- Content aimed at anyone under 18
These exist because fitness and mental health share an audience here. Content that is unremarkable to one reader can be harmful to another.
You keep ownership of what you publish. You grant us permission to host, display and deliver it to the members entitled to see it, for as long as it is on Comitry and for no other purpose. We do not resell it, and we do not use it to train anything.
5. Selling
Selling is not self-service. A person at Comitry reviews your application, approval is not automatic, and it can be withdrawn — with the reasons, and with notice unless someone's safety is at risk.
Before you can be paid you must complete Stripe's onboarding, including its identity checks. Stripe holds your identity and bank details, not us. We hold your Stripe account identifier, your country and currency, whether payouts are working, and what Stripe still needs from you.
How the money works
- You set your own monthly subscription price, between €5 and €500.
- Changing your price changes it for the next person, not for the people you already have. Somebody who subscribed at €20 keeps paying €20 for as long as they stay, however many times you raise it afterwards. You can never raise what an existing client pays, and we will never do it on your behalf. If you want more from somebody who is already with you, ask them to cancel and subscribe again at the new price — that is a conversation between the two of you rather than a change to their card charge.
- Comitry collects the payment. We are the seller to the member and the merchant on their statement, and the member's consumer rights — cancellation, withdrawal, refunds, conformity — are ours to answer.
- You keep 85% of the price after VAT. The price a member pays includes VAT at their own country's rate, and Comitry has to pay that over — so the 85% is a share of what is left, not of what the member's card was charged. A €20 subscription bought by a member in France leaves €16.67 after VAT, of which you keep €14.17. The same €20 bought in Spain leaves slightly less, because the rate there is higher. Your earnings page shows the VAT on every payment so the difference is never a mystery.
- Comitry pays Stripe's processing costs out of its own share. They are not deducted from your share, and they are not shown to you as money taken off your payout, because none of it is.
- If you publish under an organisation, subscriptions are paid to that organisation and Comitry takes no revenue share — the organisation pays for capacity instead, and your arrangement with them is between you and them.
Your earnings page shows, for every payment: what the member paid, the VAT taken out of it, our fee, your net, and anything held back after a lost dispute.
Tax
For VAT purposes, Comitry is treated as supplying the subscription to the member, and you are treated as supplying it to Comitry. That is not a choice either of us makes; it follows from how EU VAT law treats a platform that sets the terms, takes the payment and controls access. In practice:
- Comitry accounts for the VAT on what the member pays, at the rate of the member's own country, and it is calculated and itemised at checkout rather than estimated. You do not charge VAT to the member and you never have to work out a foreign rate.
- Your supply is to Comitry, in the amount you are paid. Where you are a business outside France, that supply is normally handled by us under the reverse charge, so you invoice without VAT and add the words the law requires.
- You must tell us your VAT status and give us your VAT number if you have one, and tell us if it changes. If you are not registered, tell us that too — it changes what we have to do and, in some cases, what we can afford to pay.
- We may issue invoices on your behalf where you agree in writing, and you may accept or reject each one.
[TO BE CONFIRMED: the value of the coach's supply to Comitry — whether it is the amount paid to the coach, with the 15% treated as a deduction, or the full price with a separate 15% intermediation charge. There is no binding authority on this and it matters most for coaches who are not VAT-registered or are outside the EU. An accountant should settle it and the earnings statements should follow the answer.]
You are responsible for declaring and paying your own income tax and social contributions on what you earn. We may be legally required to report what we pay you, and who you are, to a tax authority; where we are, we tell you what was reported and when. Your earnings page also links to the official guidance on the tax and social obligations that come with earning this way, because the law requires us to point you at it.
Refunds and chargebacks
Because Comitry is the party the member pays, refunds and bank disputes land on us first. What happens next between us is this:
- Where you have not delivered what you described, we may refund a client. We tell you, and why, before or at the time we do it. A refund is recovered from what we owe you for that payment.
- If a client disputes a payment with their bank, the bank decides it, and it can be decided against us regardless of the merits.
- While a dispute is open, nothing is taken from you. Disputes are sometimes won, and debiting you the moment a bank asks a question would take money we may not lose.
- We tell you when a dispute is opened, not only when it is lost, and we share what the bank has told us. You can give us anything that helps us defend it, and we will use it. You know your own content better than we do, and a dispute we can answer properly is one neither of us pays for.
- If a dispute is lost, you indemnify us for that payment, and we recover it by setting it off against what we owe you. It is capped at what you were actually paid for that payment — never more, never a second charge, and never Stripe's processing cost or its dispute fee, which we absorb.
- The deduction is identified against the specific payment and applied to a named future payout, not carried as an open-ended balance. If you have no future earnings, we will agree a proportionate way to settle it rather than pursuing you for a lump sum.
- You can contest a deduction by writing to us within 30 days, and we answer in writing with the facts we relied on.
- If disputes against you become a pattern rather than an accident, we may stop you taking new subscriptions. We will tell you in writing, with the specific facts, before it takes effect where we can, and you can respond.
6. Your clients
The coaching relationship with anyone who subscribes to you is yours. We are not a party to it.
You must not:
- Contact clients for anything other than your coaching
- Use anything you learn about a client for any other purpose, or for another business
- Repeat anything a client tells you, anywhere
- Take part in a group as an opportunity to sell
- Move a client off Comitry to be billed somewhere else while they are paying you here
You will see who subscribes to you and what they say to you. You will not see their journal, their mood entries, their card details, or any conversation you are not part of, and you can never change or cancel a client's payment method.
If a client tells you something that suggests they may be in danger, do what the Community Guidelines describe: point them to real support, report it, and contact emergency services if the risk is immediate. You are not their crisis service either, and you must never present yourself as one.
7. How members find you
Coaches are listed and searched by discipline, by what they have written on their profile, and by whether they are accepting subscribers. Those are the main things that decide the order, and they are in that order of importance: a member filtering by discipline is telling us what they came for, the text of your profile is what matches their search, and a coach not taking subscribers is no use to them.
There is no paid placement and no way to buy a better position. Nothing about how much you earn, or how much we earn from you, affects where you appear. If that ever changes we will say so here, and anything paid will be marked as paid.
You are free to sell the same thing elsewhere, at whatever price you like. We do not require you to match your Comitry price anywhere else, and we never will.
What you can and cannot see about your clients
You can see who subscribes to you, when they subscribed, what they have paid you, and anything they say to you directly or in a group you are both in.
You cannot see, and we will not give you, any member's journal, the mood attached to an entry, their card details, or any conversation you are not part of. That is not an oversight or a feature we might sell you later. It is the promise the product is built on, enforced in the code, and a member who could not rely on it would write nothing worth reading.
8. Changing, suspending and ending this
You can stop at any time. Stop publishing, stop accepting subscribers, or close your account. Your existing subscribers keep access until the end of the period they have paid for and are then not charged again. Anything you have already earned is still paid to you.
If we change this agreement, we will tell you at least
[TO BE CONFIRMED: notice period — 15 days is the minimum under the EU platform-to-business rules; 30 days is a safer default] in advance, unless the change is required by law
or is needed to deal with an immediate risk. You can end this agreement before the
change takes effect.
If we restrict, suspend or end your account, we will tell you what we decided, on what grounds, and give you the reasons in writing.
- For anything other than an immediate safety risk, a serious legal problem, or repeated breaches, we give you notice first and a chance to answer.
- Where we end the agreement entirely, we give you
[TO BE CONFIRMED: notice period — 30 days is the EU platform-to-business default]notice, unless the law, an authority, or a real risk to someone means we cannot. - You can complain, at
coaches@comitry.com. We answer in writing, and where we reasonably can a different person reviews it.
If we end things, you can take your content and your client list with you. We will give you a copy on request, and we will tell your subscribers that the subscription has ended.
9. Liability between us
You are responsible for what you publish and for the guidance you give, including for any claim a client brings about it. If we are held liable for something that was yours to get right, you will cover us for it — but only for what was actually your fault, and only to the extent the law allows.
We are responsible for running the platform with reasonable care. We are not responsible for how much you earn, for the number of subscribers you attract, or for a loss of earnings caused by an interruption to the service. Nothing here limits liability that cannot be limited by law.
10. Applicable law and disputes
- Governing law:
[TO BE CONFIRMED: governing law. If a coach is a consumer or a very small trader in another EU country, mandatory local protections may still apply.] - Courts:
[TO BE CONFIRMED: jurisdiction, and whether mediation is offered first. EU platform-to-business rules require at least two named mediators to be identified here for a platform above the small-enterprise threshold.] - Mediation:
[TO BE CONFIRMED: two named mediators, if required]
